1.The trader and the scope of these terms

These General Terms and Conditions govern the relationship between GIGACHARGER BUSINESS EOOD (“GigaCharger”, “the Company”, “we”) and anyone who uses the website gigacharger.net and the services and goods offered through it (“User”, “Customer”, “you”).

These terms have the force of a contract between you and the Company. By using the site, submitting a request or completing an order you confirm that you have read them, accept them and undertake to comply with them.

A consumer under the Bulgarian Consumer Protection Act is any natural person who acquires goods or uses services outside their trade or profession. The sections on the right of withdrawal and on claims apply to consumers only.

2.Definitions

  • Site — the website gigacharger.net together with all of its subpages and language versions.
  • Online shop — the “e-Shop” section of the Site, offering charging stations, cables and accessories.
  • Services — the supply, installation, maintenance and operation of charging stations under a chosen pricing plan.
  • Request — an invitation for a site survey and a quotation, sent through the “Request a station” form; it is not a concluded contract.
  • Order — an intention to buy specific goods declared through the Online shop, which upon confirmation gives rise to a distance contract.
  • GigaCharger app — the mobile application for Android, iOS and HarmonyOS used to start and pay for a charging session.

3.How we work — services and pricing plans

GigaCharger designs, manufactures, installs and maintains charging stations for electric vehicles. The station remains our property unless a written agreement expressly says otherwise; you receive the right to use it on the terms of the plan you choose.

The process runs in the following steps:

  1. Request. You complete the “Request a station” form or contact us by phone or e-mail.
  2. Survey and technical assessment. We check the power supply options, the mounting location and the availability of internet connectivity.
  3. Quotation. We send you specific terms for the plan you selected.
  4. Agreement. If you accept, we sign a written contract covering the term, the fees, electricity metering and maintenance. In the event of a conflict, that contract prevails over these General Terms.
  5. Installation and commissioning. The installation is carried out by our own or partner teams at an agreed time.

The current plans — FREE, FLEXI, EXCLUSIVE and CONDOMINIUM — and their monthly fees are described on the Plans page. Published prices are indicative and become binding through the quotation and the contract.

  • Installation requires that you provide access to the property, the consent of the owner or of the condominium and a feasible power supply.
  • The stations need access to a Wi-Fi network. If the site has none, we can provide connectivity on agreed terms.
  • Charging is started and paid for through the GigaCharger app.
  • You may switch plans at any time, unless the contract provides for a minimum term (for example 24 months on the EXCLUSIVE plan).
  • Maintenance and repair of the station are at our expense under normal use. Damage caused intentionally, by negligence, by unauthorised interference or by external events is recovered from the Customer.

4.Ordering from the online shop

Orders may be placed by anyone aged 18 or over with legal capacity. No registration is required — you simply provide contact and delivery details at checkout.

The distance contract is concluded as follows:

  1. You add the goods you want to the cart and review its contents.
  2. You enter your name, e-mail and phone, and choose a delivery method.
  3. The system calculates the delivery price and shows you the final amount, covering the goods and the delivery.
  4. You confirm the order and pay by bank card. Pressing the payment button constitutes an order with an obligation to pay.
  5. You receive an automatic e-mail confirmation with the order number and its contents. The contract is concluded once the payment succeeds.

Information about each product (description, technical characteristics, images, weight) is published on its page. Images are illustrative and minor differences in shade or packaging are possible.

We reserve the right to decline or cancel an order if the item is out of stock, if the price or description contains an obvious technical error, if the contact details provided are plainly incorrect or incomplete, or where abuse is suspected. In such a case we notify you at the e-mail address given and refund the amount paid in full.

5.Prices, currency and payment

All prices on the Site are final, VAT included, and are shown in euro (EUR) and Bulgarian lev (BGN) at the official fixed rate of EUR 1 = BGN 1.95583. Settlement is in euro. Delivery is charged separately and is displayed before you confirm the order.

We accept payment by bank card (Visa, Mastercard and the other methods supported by the payment form), processed by Stripe Payments Europe, Ltd. Payment takes place in a secure form hosted by Stripe — GigaCharger never receives, processes or stores your card details.

Shop orders are paid in advance. Cash on delivery is not available. If you would like to pay by bank transfer against an invoice, contact us before placing the order.

An invoice is issued on request — add your billing details in the notes field or write to us right after ordering. Prices on the Site may change, but a change never affects orders already confirmed.

6.Delivery with Econt

Deliveries are carried out by Econt Express OOD, company no. 117047646. At checkout you choose one of the following:

  • To an Econt office — you pick the specific office from the list.
  • To an Econt parcel machine (Econtomat) — for parcels of a suitable size.
  • To an address — you specify city, district, street and number.

The delivery price is calculated automatically by Econt's system from the weight, size and chosen destination, and is shown before payment. In certain cases — for example collection from an office or parcel machine, orders above a given value, or promotional terms — delivery is at our expense; this is stated explicitly in the cart.

  • Dispatch time: we process orders within 1–2 business days of the payment clearing.
  • Delivery time: typically 1–3 business days within Bulgaria after the parcel is handed to the courier.
  • Coverage: we deliver within the Republic of Bulgaria. For delivery to another country, contact us for an individual quote.
  • Delivery times do not run on public holidays, or during force majeure events, of which we will inform you promptly.

On receipt you have the right to inspect the parcel in the courier's presence. If you find visible damage to the packaging or a discrepancy, ask the courier to draw up a report and notify us the same day at sales@gigacharger.net. This does not limit your other rights under these terms or the law.

If you cannot be found at the address given, or do not collect the parcel from the office within the courier's storage period, the parcel is returned to us. In that case we may deduct the delivery and return costs actually incurred from the amount refunded.

7.14-day right of withdrawal

As a consumer you have the right to withdraw from a distance contract within 14 days, without giving a reason and without owing any compensation or penalty (Art. 50 of the Bulgarian Consumer Protection Act).

The period runs from the day on which you, or a third party you named (other than the courier), took possession of the goods. Where an order contains several items delivered separately, it runs from receipt of the last one.

To exercise the right, send us an unequivocal written statement before the period expires, to sales@gigacharger.net or to 16 Tsarkovna Nezavisimost St, 7000 Ruse, Bulgaria. You may use the standard withdrawal form under Annex 6 to Art. 47(1)(8) and Art. 52(2) of the Consumer Protection Act, but you are not obliged to. We will acknowledge receipt of your withdrawal by e-mail.

  • Returning the goods. Send back or hand over the goods no later than 14 days from the day you told us about the withdrawal.
  • Cost of return. The direct cost of returning the goods is yours, unless we have expressly agreed to bear it.
  • Refund. We refund all payments received from you, including the cost of standard delivery, within 14 days of the day we were informed of the withdrawal. If you chose a more expensive delivery method than the cheapest standard one we offer, the extra cost is not refundable.
  • Method of refund. The refund is made using the same payment instrument you used, unless you expressly agree otherwise. It costs you nothing.
  • Withholding. We may withhold the refund until we receive the goods back, or until you supply evidence that you have sent them — whichever is earlier.
  • Diminished value. You are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

Goods should be returned in their original packaging, with all accompanying documents, accessories and any gifts supplied. If we failed to inform you of the right of withdrawal, the period is extended by 12 months after the end of the initial 14 days.

8.When the right of withdrawal does not apply

Under Art. 57 of the Consumer Protection Act, the right of withdrawal does not apply — among the other statutory cases — to:

  • goods made to your specification or clearly personalised (for example stations with a bespoke configuration, branding or a non-standard cable length);
  • services fully performed with your prior express consent and your acknowledgement that you will lose the right of withdrawal once performance is complete — for example a completed installation;
  • sealed goods unsealed after delivery which cannot be returned for reasons of hygiene or health protection;
  • goods which, after delivery, are by their nature inseparably mixed with other items;
  • contracts where the consumer specifically requested a visit for urgent repairs.

The right of withdrawal also does not apply where the buyer is not a consumer, i.e. acquires the goods within their trade or profession.

9.Conformity, guarantee and claims

We are liable for any lack of conformity of the goods with the contract that exists at delivery and becomes apparent within two years of delivery. During the first year the lack of conformity is presumed to have existed at delivery unless proven otherwise.

Where goods are not in conformity you are entitled, at your choice, to repair or replacement — free of charge, within a reasonable time and without significant inconvenience to you. Where repair or replacement is impossible, disproportionate or not carried out within a reasonable time, you are entitled to a proportionate price reduction or to terminate the contract and be refunded.

A claim may be made by phone on +359 877 442 442, in writing to sales@gigacharger.net or at 16 Tsarkovna Nezavisimost St, 7000 Ruse, Bulgaria. The period for bringing a claim is two years from delivery; for a claim about a service it is 14 days from discovering the lack of conformity.

When making a claim, state the subject matter of the claim, your preferred remedy (or the amount claimed) and an address and phone for contact. Attach the documents your claim relies on — a receipt, invoice or other proof of purchase, and any reports establishing the lack of conformity.

We keep a register of claims. When a claim is accepted you receive a document showing its number, date and entry in the register. Bringing the goods into conformity is carried out within a reasonable time and no later than one month from the claim being made.

The statutory guarantee of conformity applies regardless of whether the manufacturer offers an additional commercial guarantee. Where one exists, its terms are supplied with the product's guarantee card and can never limit your statutory rights.

A claim is not upheld for damage caused by incorrect installation by a third party, mechanical damage, use other than as intended, external events (overvoltage, lightning, flooding), or interference or repair by an unauthorised person.

10.Rules for using the site

You undertake to use the Site in good faith and not to act in ways that could disrupt its operation or infringe third-party rights. In particular, the following are not permitted:

  • providing false, third-party or misleading details in a request or order;
  • automated harvesting of content, overloading the infrastructure or circumventing security measures;
  • attempting unauthorised access to the admin area, to other people's orders or to other people's data;
  • distributing malicious code, spam or content that breaches the law or accepted standards of conduct.

You are responsible for the accuracy of the details you provide. Where details are plainly false we may decline to perform, without incurring liability.

11.Intellectual property

All content on the Site — text, images, video, product descriptions, the logo, trade marks, design and source code — is protected by the Bulgarian Copyright and Related Rights Act and is owned by GigaCharger or used on a lawful basis.

Copying, reproducing, publicly distributing or commercially exploiting content from the Site without prior written consent is prohibited. Quotation is permitted with a clear attribution and an active link to the relevant page.

12.Liability

We make reasonable efforts to keep the Site available and its information accurate and current. We do not guarantee uninterrupted access and are not liable for damage caused by temporary unavailability due to maintenance, technical problems at our providers or force majeure.

We are not responsible for the content of external sites we link to, nor for third-party services (courier, payment processor, internet provider), beyond the liability the law places on us as a trader.

The electric-vehicle data published in the “Electric cars” section is informational, collected from public sources and manufacturers, and is neither an offer nor a warranty of specific technical figures.

13.Personal data and cookies

We process personal data in accordance with Regulation (EU) 2016/679 and the Bulgarian Personal Data Protection Act. Full information on purposes, legal bases, retention and your rights is available in the Privacy Policy.

The Site uses cookies. Optional analytics and marketing cookies load only after your consent, which you can change at any time from the “Cookie preferences” button in the footer. The list of cookies is published in the Cookie Policy.

14.Changes to these terms

We may amend these General Terms when the services we offer, the providers we use or the applicable law change. The current version is published at this address with the date of the last revision.

Contracts already concluded and orders already confirmed are governed by the version in force when they were made. If you hold a long-term contract with us, we will notify you of an amendment at the e-mail address you gave at least 7 days before it takes effect; if you do not accept the change, you may terminate the contract without penalty.

15.Governing law and dispute resolution

Matters not covered by these General Terms are governed by Bulgarian law, including the Consumer Protection Act, the Electronic Commerce Act, the Act on the Supply of Digital Content and Digital Services and the Sale of Goods, and the Obligations and Contracts Act.

We aim to resolve every dispute amicably. If no agreement is reached, as a consumer you have the following options:

  • Commission for Consumer Protection (CPC) — 4A Slaveykov Sq., fl. 3, 4 and 6, 1000 Sofia, tel. 0700 111 22, info@kzp.bg, kzp.bg.
  • The conciliation commissions at the CPC — alternative dispute resolution, free of charge for the consumer.
  • European Consumer Centre Bulgaria — for a cross-border dispute with a trader from another EU member state, ecc.bg.
  • The competent Bulgarian court, under the general rules of the Code of Civil Procedure.

The European Commission's Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025 by Regulation (EU) 2024/3228 and no longer accepts complaints. Please use the bodies listed above.

16.Final provisions

If any clause of these General Terms is held invalid, the validity of the remaining clauses is unaffected. The invalid clause is replaced by the mandatory rules of the law.

Correspondence between the parties is conducted at the addresses and e-mail addresses stated. A message sent to the e-mail address you provided is deemed received. The language of the contract and of communication is Bulgarian; the English version of the Site is provided for convenience and, in the event of a discrepancy, the Bulgarian text prevails.
